A Florida resident has filed a lawsuit against two local businesses, alleging negligence after a fall on their premises. Dolores DeLeon, the plaintiff, submitted her complaint to the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on February 13, 2025. The defendants named in the case are Shoppes at Boynton, LLC and Lombardi Development, LLC.
According to the complaint, DeLeon claims that on May 16, 2024, she visited the premises of Shoppes at Boynton located at 701 N. Congress Avenue in Boynton Beach. At that time, construction was underway in the parking lot, necessitating a temporary handicap ramp for visitors to access the sidewalk. DeLeon alleges that this ramp was improperly secured and lacked necessary handrails. As a result of these conditions, she tripped and fell while attempting to use it. "The injuries resulting from this fall were due solely and wholly as a result of the negligent manner that the Defendants...operated...the aforesaid Premises," states the complaint.
DeLeon's lawsuit accuses both Shoppes at Boynton and Lombardi Development of failing to provide a safe environment for visitors by not securing the temporary ramp properly or installing handrails. She argues that they breached their duty of care by allowing such hazardous conditions to exist without adequate warning or correction. The complaint lists numerous alleged failures by both companies including inadequate maintenance and inspection procedures which led to her injury.
In seeking justice from the court, DeLeon is demanding damages exceeding $50,000 exclusive of costs and interest. She requests compensation for physical injuries sustained during her fall along with associated pain and suffering which include mental anguish and loss of enjoyment of life among others. Furthermore, she seeks coverage for medical expenses incurred as well as potential future earnings lost due to her injuries.
