Condominium Resident Alleges Negligence Against Property Owners Association Over Unsafe Conditions

A resident of a condominium complex in Boynton Beach, Florida, has filed a lawsuit against the property owners association, alleging negligence in maintaining safe conditions on the premises. Marvin Hoffman initiated the complaint on April 30, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Banyan Springs Property Owners Association, Inc.

The case revolves around an incident that occurred on June 13, 2024. According to the complaint, Marvin Hoffman was residing at a building located at 10101 Mangrove Drive when he suffered injuries due to allegedly hazardous conditions on the property. The plaintiff claims that the defendant negligently maintained the stairs within the condominium complex, leading to his fall and subsequent injuries. Hoffman asserts that Banyan Springs Property Owners Association failed to warn him about this dangerous condition and that they either knew or should have known about it due to its existence over a sufficient period.

Hoffman describes his injuries as severe and encompassing bodily harm resulting in pain and suffering, disability, disfigurement, mental anguish, and loss of enjoyment of life. He also cites expenses related to hospitalization and medical care along with lost earnings and diminished earning capacity. Furthermore, he claims activation or aggravation of a pre-existing condition due to this incident. The plaintiff believes these losses are either permanent or ongoing and will continue to affect him in the future.

In his lawsuit, Marvin Hoffman is seeking damages exceeding the court's minimum jurisdictional limits. He demands judgment against Banyan Springs Property Owners Association for damages along with interest and costs. Additionally, he requests any further relief deemed appropriate by the court under these circumstances. Hoffman has also requested a trial by jury for all issues eligible for such proceedings.
