It alleges that Palm Beach County had control over the park and its facilities and thus had a duty to ensure their safety. The plaintiff accuses the county of negligence for failing to maintain or repair the dugout bench properly and not warning visitors about its hazardous condition.
Walsh's legal team argues that Palm Beach County either knew or should have known about the dangerous condition posed by the dugout bench but did not take appropriate action to rectify it. They claim this negligence directly led to Walsh's injuries, which include bodily harm, pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, lost earnings potential, and aggravation of pre-existing conditions.
