Leslie Albert, a resident of Palm Beach County, Florida, has filed a lawsuit against Florida Atlantic University Board of Trustees and Metroplex Piano, Inc., seeking damages in excess of $50,000. The complaint was lodged on March 21, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County. Albert alleges negligence on the part of both defendants after suffering injuries from tripping over a forklift prong left near an unlit entrance at the university's Visual Arts building.
The incident occurred on March 4, 2024, when Leslie Albert was visiting Florida Atlantic University as a business invitee. According to the complaint, Albert fell over a forklift prong that had been negligently left by Metroplex Piano after delivering a piano to the campus. The lawsuit claims that both defendants failed to maintain safe premises and did not warn about the hazardous condition. "The Defendant...had actual or constructive knowledge of the dangerous condition and failed to take action to remedy it," states the complaint.
Albert's legal team argues that Florida Atlantic University Board of Trustees neglected their duty to ensure safety for visitors by failing to properly maintain their property and address known dangers. Similarly, Metroplex Piano is accused of creating an unsafe environment through its business activities. Both parties are alleged to have violated applicable building codes and statutes by not addressing foreseeable risks.
As a result of this negligence, Leslie Albert reportedly suffered significant physical injuries including pain and suffering, disability, mental anguish, and loss of enjoyment of life. The complaint outlines these damages as permanent or continuing in nature with future implications for Albert's quality of life and earning capacity.
Albert seeks judgment for damages against both defendants along with costs and post-judgment interest. The plaintiff also demands a jury trial to resolve these claims. Representing Leslie Albert is attorney Matthew E. Haynes from Lytal Reiter Smith Ivey & Fronrath law firm based in West Palm Beach.
