Woman takes claim against CitiMortgage to federal court

MIAMI — A Florida woman is removing a claim against CitiMortgage Inc., originally filed in Miami-Dade County Circuit Court, to federal court, alleging violation of federal real estate law.

Oneida Lopez filed a suit on Dec. 30 in the U.S. District Court for the for the Southern District of Florida Miami-Dade Division against CitiMortgage Inc., alleging violation of the Real Estate Settlement Procedures Act (RESPA), violation of Regulation X, and purported negligence.

The claim signifies a removal of an action pending in the Circuit Court in and for the Eleventh Judicial Court in Miami-Dade County, Florida, allegedly pursuant to a question of federal jurisdiction. Lopez claims the defendant violated RESPA and Regulation X, and in doing so, acted with willful negligence. She seeks to remove her claim to a federal court to receive judgment under applicable federal law.

Lopez seeks removal and damages pursuant to the previously filed claim. She is represented by Victor R. Berwin, Brandon G. Forgone, and William P. Heller.
