Blind man sues FedEx after it wouldn't accommodate his disability

A blind man has sued FedEx claiming the company refused to accommodate his disability.

Clinton Von Aiken filed his complaint in federal court against FedEx Ground Package System Inc.

According to the compalint, Aiken suffers from diabetic retinopathy and glaucoma. He says FedEx failed to provide reasonable accommodations for his disability, which he believes constitutes discrimination and retaliation under Title I of the American with Disabilities Act.

Aiken says he had applied online for a package handler position at FedEx in Miami in August 2023. After being offered the job and accepting it, Aiken informed FedEx about his blindness and need for accommodations. However, according to Aiken's complaint, FedEx responded that it was "unable to provide accommodations," effectively rescinding their offer of employment.

Aiken seeks declaratory and injunctive relief, back pay and prejudgment interest, damages, attorneys’ fees, expenses, and costs of litigation.
