Daiana Rosa Morales has filed a lawsuit against her former employer, Pedi Pec, Inc., alleging discrimination and retaliation based on her sex and pregnancy. The complaint was filed in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on January 28, 2025. Morales claims that Pedi Pec unlawfully discriminated against her due to her pregnancy and related medical conditions, violating the Florida Civil Rights Act of 1992.
According to the court documents, Daiana Rosa Morales began working for Pedi Pec as a Registered Nurse on April 27, 2021. She was recognized as an exemplary employee with a history of positive performance. However, her situation changed dramatically when she discovered she was pregnant on September 24, 2023. Despite initial joy over the news, Morales soon faced medical complications related to her pregnancy. On October 12, 2023, she experienced severe pain and bleeding but continued to work while notifying her supervisor about her condition without disclosing her pregnancy.
Morales informed another supervisor about her pregnancy and health issues on October 13, 2023. Her physician advised rest due to a chorionic hematoma diagnosis related to her pregnancy. Despite receiving medical clearance under pressure from financial concerns and fear of retaliation from Pedi Pec, Morales returned to work on October 24, 2023. Just days later, on October 27, she was terminated without prior notice or justification related to performance issues.
The lawsuit alleges that Pedi Pec's actions constituted unlawful discrimination based on sex and pregnancy and failed to accommodate Morales's requests for adjustments due to her medical condition. Furthermore, it accuses the company of retaliating against Morales for exercising her rights under employment law by terminating her employment shortly after requesting accommodations.
Morales seeks various forms of relief from the court including economic damages such as lost wages (both back pay and front pay), compensatory damages for emotional distress and other non-economic losses suffered due to alleged discrimination and retaliation by Pedi Pec. Additionally, she requests punitive damages due to what she describes as intentional discriminatory conduct by the defendant.
