According to the complaint, Thomas Woodman was working at Ferrari of Palm Beach on January 31, 2023, when he used an elevator maintained by TK Elevator Corporation. The elevator unexpectedly descended rapidly and stopped abruptly, causing Woodman to sustain injuries despite exercising due care for his safety. The plaintiff accuses TK Elevator Corporation of negligence for not maintaining the elevator in a safe condition as required by their contract with Ferrari of Palm Beach.
Woodman's lawsuit asserts that TK Elevator Corporation had a duty to ensure the elevator's safety for all users at the premises. He alleges that their failure to do so resulted in a mechanical failure that led to his injuries. "Defendant TK ELEVATOR’s breach of its duty to Plaintiff was the direct and proximate cause of Plaintiff’s injuries," states the complaint.
