Gregg Hollander has filed a medical negligence lawsuit against a dental practitioner and his practice, alleging severe injury due to a botched dental procedure. The complaint was lodged in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on January 21, 2025, targeting Glen Mitchell, D.D.S., and Glen Mitchell Endodontics, P.A.
According to the complaint, Gregg Hollander claims that on February 8, 2023, he underwent an apicoectomy surgery at the office of Glen Mitchell in Boca Raton. The procedure was recommended by Dr. Mitchell himself for tooth number thirty. However, during this surgery, Dr. Mitchell allegedly caused permanent nerve damage to Hollander's trigeminal nerve. This injury resulted in significant sensory dysfunction for Hollander, which he asserts would not have occurred but for Dr. Mitchell's negligence.
Hollander accuses Dr. Mitchell of several breaches of duty including failing to obtain informed consent prior to the surgery and not adequately protecting critical nerves during the procedure. "The permanent nerve injury and resulting sensory dysfunction suffered by Plaintiff are injuries that would not occur but for the negligence of Defendant," states the complaint. Additionally, Hollander argues that Glen Mitchell Endodontics is vicariously liable for Dr. Mitchell’s actions since he was acting within his employment scope when performing the surgery.
In seeking redress from the court, Hollander demands compensatory damages exceeding $50,000 for bodily harm encompassing permanent nerve damage leading to pain and suffering as well as loss of life enjoyment among other grievances. He also requests a jury trial to address all issues raised in his complaint.
