Charlotte Deroche, a Florida resident, has filed a lawsuit against two foreign limited liability companies, Revantage Corporate Services, LLC and Excel Gardens, LLC. The complaint was filed on May 2, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida. The lawsuit stems from an incident that occurred on November 24, 2023, when Deroche alleges she fell due to negligently designed and maintained pavers at Downtown Palm Beach Gardens.
According to the complaint filed by Deroche's attorney Jeffrey Martz of Smith, Ball & Baez Injury Lawyers, both Revantage Corporate Services and Excel Gardens were responsible for maintaining the property where the incident took place. The companies are accused of failing to ensure the safety of their premises at Downtown Palm Beach Gardens located at 11701 Lake Victoria Gardens Ave. Deroche claims that both defendants had a legal duty to keep the sidewalks and walkways safe and free from dangerous conditions but failed to do so.
The complaint outlines several accusations against the defendants including negligence in inspecting and maintaining the premises. It is alleged that they allowed a hazardous condition to exist due to poorly designed pavers which created an unreasonably dangerous environment for pedestrians. "The dangerous and hazardous condition...was known or should have been known to the Defendant," states the complaint. Furthermore, it accuses them of not providing adequate warnings about these dangers nor implementing proper safety procedures.
Deroche is seeking compensatory damages exceeding $50,000 for her injuries which include serious bodily harm resulting in pain and suffering, disability, mental anguish, inconvenience, loss of enjoyment of life as well as past and future medical expenses. She also seeks economic damages for lost wages and diminished earning capacity along with pre- and post-judgment interest.
