Plaintiff Elie Damus alleges negligence against property owner Tzadik LLC and manager Optimar Realty Group

Elie Damus has filed a lawsuit against two Florida-based companies, alleging negligence after suffering severe injuries from a fall due to an unsecured balcony railing. The complaint was filed in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on January 6, 2025, naming Tzadik LLC and Optimar Realty Group, LLC as defendants.

According to the complaint, Elie Damus was residing at a property located at 2259 Linton Ridge Circle, Delray Beach when he fell from the second floor to the ground floor on January 5, 2023. The incident occurred because of an unsecured railing on the balcony of his unit. Damus claims that both Tzadik LLC, which owned and maintained the property, and Optimar Realty Group, LLC, which managed it, were negligent in their duties to ensure the premises were safe for residents and visitors.

The plaintiff argues that Tzadik LLC had a non-delegable duty to maintain the property in a reasonably safe condition. The company allegedly failed to uphold this duty by not maintaining or adequately inspecting the balcony railings and not warning residents about the dangerous condition. Damus contends that Tzadik either knew or should have known about the hazard due to its existence over time but did nothing to correct it. As a result of this negligence, Damus suffered severe bodily injuries leading to pain and suffering, impairment, disability, disfigurement, mental anguish, and financial losses related to medical care and loss of earnings.

Similarly, Damus accuses Optimar Realty Group of breaching its duty as property manager by failing to maintain safe conditions on the premises. Like Tzadik LLC, Optimar is accused of neglecting necessary inspections and repairs on the balcony railings while also failing to warn residents about potential dangers. The plaintiff claims that these failures directly contributed to his accident and subsequent injuries.

Damus seeks damages exceeding $50,000 from both defendants for his injuries and associated losses. He requests judgment for damages along with costs and interest as deemed appropriate by the court. Additionally, he demands a jury trial for all issues eligible for such proceedings.
