Sharon Martinez has filed a lawsuit against a homeowners association and its management company, alleging negligence that led to her injury. The complaint was lodged in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on January 9, 2025, naming Arden Homeowners Association, Inc. and Capital Consultants Management Corporation as defendants.

The case revolves around an incident that occurred on August 10, 2024, when Martinez was entering the Arden Community Amenity Center. She claims her view was obstructed by pedestrians and design flaws at the entrance, leading her to trip over traffic cones improperly placed by the defendants. These cones were not clearly visible or safely positioned, violating safety standards and creating a hazardous condition at a busy egress doorway. As a result of this alleged negligence by both the property owner and manager, Martinez sustained injuries including aggravation of pre-existing conditions.

Martinez's complaint outlines several counts of negligence against both defendants. She accuses Arden Homeowners Association of failing to maintain safe egress areas as required by local ordinances and safety standards like NFPA 101. Similarly, Capital Consultants Management Corporation is charged with negligent supervision and maintenance for allowing obstructions in critical areas meant for safe passage. Both entities are also held vicariously liable for their employees' actions that allegedly contributed to the dangerous situation.

In seeking justice, Martinez demands compensatory damages exceeding $50,000 for physical pain, medical expenses, lost earnings capacity, mental anguish, and other related losses under Florida law. She requests a jury trial to address these grievances and any additional relief deemed appropriate by the court.
