Resident Alleges Negligence Against Property Managers Following Injury

A Palm Beach County resident has filed a lawsuit against several property management companies, alleging negligence that led to her injury. On December 18, 2024, Jean Council submitted a complaint in the Circuit Court of Palm Beach County, Florida, targeting Royal St. George Apartments KOFP Owner LLC, Morgan Properties Management Company LLC, and Windward at the Village KOFP Owner LLC.

The lawsuit stems from an incident on July 30, 2023, when Jean Council claims she was injured due to hazardous conditions at her residence within the Royal St. George at the Villages Apartment Homes in West Palm Beach. According to the complaint, Council was caused to slip and fall because of debris accumulation on stairs and walkways following a tree removal operation that allegedly left dirt and sand scattered across common areas. The plaintiff argues that these dangerous conditions were known or should have been known by the defendants who had responsibilities for maintaining safe premises.

Jean Council's complaint accuses Royal St. George Apartments KOFP Owner LLC of failing to maintain their property safely and neglecting to warn residents about potential hazards. She asserts that the company did not take necessary actions such as proper maintenance of stairs and walkways or providing adequate warnings about unsafe conditions. The lawsuit further implicates Morgan Properties Management Company LLC for similar failures in upkeep and safety measures concerning public areas around the apartment complex.

Additionally, Windward at the Village KOFP Owner LLC is accused of negligence in managing and maintaining its premises. The plaintiff alleges that all three defendants failed in their duty of care by not implementing sufficient procedures for inspection and repair after landscaping activities that resulted in hazardous conditions.

Jean Council seeks compensatory damages for her injuries which include pain and suffering, disability, medical expenses, loss of wages, and diminished earning capacity. Her legal team demands a jury trial to resolve these issues.
