MIAMI – A Miami-Dade County employer that sells SIM cards for cellphones is accused of terminating an employee in retaliation for his complaints about not receiving overtime pay.
Eduardo Acosta filed a complaint on behalf of similarly situated individuals on March 9 in the U.S. District Court for the Southern District of Florida, Miami Division against Lyca Tel LLC citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he began working for the defendants to sell SIM cards in November 2015 and was unlawfully terminated in December 2016. The plaintiff holds Lyca Tel LLC responsible because the defendant allegedly terminated plaintiff's employment in retaliation his complaints about not being paid any overtime wages. He also alleges he was not paid commissions as promised.
The plaintiff requests a trial by jury and seeks all back wages, liquidated damages, front wages, compensatory damages, all legal fees and any other relief as this court deems just. He is represented by Gary A. Costales of Gary A. Costales PA in Miami.
