MIAMI – A Delray Beach business and North Carolina man alleges a San Diego blogger published defamatory statements.
Sovereign Offshore Services LLC and Paul Mampilly filed a complaint on Feb. 13 in the U.S. District Court for the defamation.
According to the complaint, the defendant writes and publishes a blog titled the San Diego Consumers' Action Network. The plaintiffs allege that on Oct. 25, 2016, and on Nov. 17, 2016, the defendant published posts making claims that Mampilly is an investment scammer and engages in abusive email practices. The plaintiff alleges that such claims are false. The suit states that Mampilly writes the Profits Unlimited newsletter that Sovereign Offshore Services publishes.
The plaintiffs hold Shames responsible because the defendant's statements have allegedly damaged the plaintiffs' business reputation, exposed them to ridicule and have cost them subscribers.
The plaintiffs seek judgment in their favor, permanent injunction, compensatory and punitive damages, interest, costs, attorneys’ fees, and further relief as the court deems appropriate. They are represented by Franklin L. Zemel of Arnstein & Lehr LLP in Fort Lauderdale and Katrina J. Dennis and Jordan D. Rosenfeld of Saul Ewing LLP in Baltimore.
