FORT MYERS – A Collier County cashier has filed a class-action lawsuit her former employer alleging she was not paid overtime wages.
Andry Toro-Angulo filed a complaint on behalf of and those similarly situated on April 21 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Hometown Ventures LLC, doing business as Maxx Foods 2, and Alex Jivani alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff worked for the defendant from July 2014 to April 2015 and alleges that she worked in excess of 40 hours during one or more weeks during her employment without proper compensation. The plaintiff holds Hometown Ventures LLC and Alex Jivani responsible because the defendants allegedly failed to compensate her at a rate of time-and-one-half of her regular rate for all hours worked in excess of 40 hours per work week, failed to maintain proper time records and failed to apprise of her rights under the FLSA.
The plaintiff requests a trial by jury and seeks declaration that the defendants violated the provisions of FLSA, compensation for overtime wages due, liquidated damages, attorney's fees and costs, prejudgment interest and any other relief that the court may deem just and proper.
