In the Circuit Court of the 15th Judicial District in Palm Beach County, Florida, plaintiffs Michael Cothran and Shirley Cothran have filed a lawsuit against Waterways of Naples Homeowners’ Association, Inc., a Florida Not for Profit Corporation, and Alliant Property Management, LLC, a Florida Limited Liability Company. The case number is 502024CA003246XXXAMB Div: AA and was filed on April 5, 2024.

The plaintiffs are represented by their undersigned counsel and are suing for damages exceeding $50,000. The Cothrans allege that they suffered significant injuries due to uneven concrete slabs on a walkway within the Waterways of Naples Community which caused Michael Cothran to trip and fall on December 6, 2022.

The defendants are accused of negligence as they allegedly knew or should have known about the dangerous condition of the walkway. They are being held responsible for maintaining safe conditions in common areas within their property.

The plaintiffs seek judgment against both defendants for failing to maintain a safe environment and warn residents about potential hazards. They claim that the defendants' negligence resulted in serious and permanent injuries to Michael Cothran.
