According to the complaint, Tomeka Bryant was traveling on a sidewalk or roadway located at 2001 Palm Beach Lakes Boulevard when she encountered a dangerous condition. The City of West Palm Beach is accused of failing to construct, manage, maintain, inspect, and repair the sidewalk/roadway in a reasonably safe condition. The plaintiff claims that this negligence led to an unreasonably dangerous condition characterized by an uneven or bulging section of the sidewalk/roadway that presented an abrupt change in elevation. This defect allegedly impeded safe passage for motorists and pedestrians alike.
Bryant's legal team argues that the City of West Palm Beach had a duty to exercise reasonable care and diligence in maintaining its roadways for public safety. They claim that the city either knew or should have known about the hazardous condition through reasonable care but failed to take corrective action or warn pedestrians like Bryant about it. As a result of this alleged negligence, Bryant suffered bodily injury leading to pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, and loss of earnings.
The plaintiff is seeking damages exceeding $50,000 from the City of West Palm Beach for these injuries and losses. Additionally, Bryant demands a trial by jury to resolve her claims against the municipality.
