A slip-and-fall incident at a well-known convenience store chain has led to a lawsuit alleging negligence. Michael Frazier filed a complaint against RaceTrac, Inc. in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on April 18, 2025. The complaint accuses RaceTrac of failing to maintain safe conditions on their property, resulting in Frazier's injury.

The lawsuit stems from an incident that occurred on September 29, 2023, when Michael Frazier was lawfully present at a RaceTrac location at 2995 45th Street, West Palm Beach, Florida. According to the complaint, while exercising due care for his safety, Frazier slipped and fell in the parking lot due to what he describes as "a transitory foreign substance" on the painted asphalt that lacked sufficient slip resistance. Frazier alleges that RaceTrac had a duty to maintain its property safely and failed to do so by not using proper materials or warning patrons of potential hazards.

Frazier's legal team argues that RaceTrac breached its duty of care through several acts of negligence. These include failing to properly inspect and maintain the parking lot for dangerous conditions and not using appropriate paint or additives for slip resistance. Additionally, they claim that the painted area did not comply with applicable codes and industry standards. The complaint further asserts that these hazardous conditions were regular occurrences that RaceTrac should have been aware of.

As a result of this alleged negligence, Frazier claims he has suffered significant injuries leading to severe physical pain and suffering, mental anguish, disability, disfigurement, and loss of enjoyment of life. He also cites medical expenses and lost wages as part of his damages. The lawsuit seeks damages exceeding $50,000 along with costs and any other relief deemed appropriate by the court. Furthermore, Frazier demands a jury trial for all issues triable as a matter of right.
