The lawsuit arises from an incident on November 25, 2024, when Nalls visited the premises owned by the defendants at 720 US 1 Lake Park, Florida. According to the complaint, while lawfully on the property as a business invitee, Nalls tripped and fell due to what he claims was a negligently maintained walking surface. The fall resulted in permanent bodily injury for which Nalls holds both Carving Station Buffet and Seaglades Investment accountable. The plaintiff asserts that these companies had exclusive possession and control over the property and failed in their duty to maintain it safely for guests.

Nalls' legal representation argues that both defendants breached their non-delegable duty of care by failing to ensure safe conditions on their premises. Specific allegations include negligence in maintaining or inspecting the property adequately, creating trip hazards, failing to warn about existing dangers such as holes or pipes sticking up from surfaces, and not adhering to corporate policies designed to prevent such accidents.
