A Florida resident has filed a lawsuit against a major retail corporation, alleging negligence that led to significant personal injuries. On March 27, 2025, Fatime Zogolo filed a complaint in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, against Wal-Mart Stores East, LP.
The case revolves around an incident that occurred on December 19, 2024, when Zogolo visited a Wal-Mart store located at 1803 N. Highland Ave., Clearwater. As a business invitee, she claims she was owed a duty of care by the defendant to ensure her safety while on their premises. The complaint outlines that Wal-Mart allegedly failed to maintain safe conditions within their store's produce section. Specifically, Zogolo asserts that she slipped and fell on a liquid substance due to negligent maintenance and inadequate warnings about potential hazards.
Zogolo accuses Wal-Mart of several specific acts of negligence: failing to properly maintain the flooring near the produce section; creating slip hazards; neglecting necessary inspections; failing to warn patrons of dangers; not correcting known dangerous conditions; insufficient staffing for maintenance tasks; inadequate employee training regarding floor safety; and failing to provide safe flooring surfaces. These alleged oversights resulted in Zogolo suffering extensive injuries including pain and suffering, disability, disfigurement, permanent scarring, mental anguish, and loss of enjoyment of life. She also cites expenses related to medical care and treatment as well as lost earnings capacity.
In her lawsuit, Zogolo seeks damages exceeding $50,000 exclusive of costs and interest. She demands a jury trial to determine fair compensation for her injuries and losses. Her legal representation is handled by Michael C. Bird from Morgan & Morgan Tampa P.A., who has filed this action with expectations for accountability from Wal-Mart regarding their premises' safety standards.
This case is being presided over under Case Number 25-001500-CI with Michael C. Bird serving as Zogolo's attorney from Morgan & Morgan Tampa P.A., located at 201 N. Franklin St., Tampa.
