A resident of a mobile home park in Florida has filed a lawsuit against the property management company, alleging negligence after suffering significant injuries from a fall. Timothy Donnery initiated legal action against Crosswinds MHC, LLC on March 27, 2025, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida.
The complaint outlines that on February 24, 2024, Donnery was residing at the premises managed by Crosswinds MHC, LLC when he tripped and fell due to a hole in the roadway. The plaintiff claims that the defendant had control over the premises and thus held a non-delegable duty to ensure his safety by maintaining the property in a reasonably safe condition. According to Donnery's allegations, Crosswinds MHC failed to fulfill this duty by not adequately maintaining or inspecting the roadway for hazards like the hole that caused his accident.
Donnery accuses Crosswinds MHC of several acts of negligence: failing to maintain or repair the roadway adequately; neglecting to inspect for potential hazards; not warning residents about dangerous conditions; and not addressing known issues despite having ample time and opportunity. As a result of these alleged oversights, Donnery suffered bodily harm leading to pain and suffering, disability, disfigurement, mental anguish, and other damages such as medical expenses and loss of earnings.
In seeking justice through this lawsuit, Donnery demands compensation exceeding $50,001 for damages along with costs related to legal proceedings. He also requests pre-judgment interest on past medical expenses from when payments were made and reimbursement for any wage losses incurred due to his injuries. Additionally, he insists on having a jury trial to resolve this matter.
