A Pinellas County couple is taking legal action against two construction companies over alleged negligent practices that have left their newly purchased home riddled with defects. On February 10, 2025, Haley Dawn Crum and Shelby Crum filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Forrest Park Development LLC and Largo Glass, Inc., claiming negligence and violations of the Florida Building Code.
The lawsuit centers around a property located at 402 Hillsborough Street in Palm Harbor, which the Crums acquired on May 31, 2024. The plaintiffs allege that shortly after moving into their new home, they began to notice significant water intrusion issues around windows and other areas. They hired a licensed building envelope consultant who identified numerous construction defects that failed to meet industry standards and building codes. According to the complaint, "Defendants failed to reasonably and adequately design, develop, and/or construct the Home," leading to extensive damage.
Forrest Park Development LLC (FPD), described as a developer and licensed contractor responsible for constructing the home, is accused of failing to ensure compliance with permitted plans and specifications as well as the Florida Building Code. The plaintiffs argue that FPD breached its duty by negligently developing and constructing the home with defective conditions such as improperly installed windows and stucco systems. As a result of these alleged failures, the Crums claim they have suffered damages exceeding $50,000.
Largo Glass Inc., contracted by FPD for installing doors and windows, is also named in the suit for similar allegations of negligence. The complaint asserts that Largo Glass did not perform its scope of work with reasonable care or in compliance with relevant standards. Specific deficiencies include improperly flashed windows and inadequately installed sliding doors.
The plaintiffs are seeking judgment against both defendants for various forms of relief including costs for repairs and remediation of defects, loss of use compensation, temporary housing costs during repairs, diminution in property value due to these issues, incidental damages caused by construction deficiencies, prejudgment interest on incurred expenses related to this lawsuit’s prosecution efforts among others requested from court proceedings.
