Shopping Plaza Owners Accused of Negligence After Visitor Injury

In a gripping legal battle that could set a precedent for property management liability, a Florida resident has filed a lawsuit against three companies following an incident at a Boca Raton shopping plaza. Timothy Evans, the plaintiff, lodged his complaint in the Circuit Court of the 154th Judicial Circuit in Palm Beach County on April 17, 2025, targeting Janoura Realty & Management, Inc., Boca SVP, LLC, and Oilmatic Systems, LLC as defendants.

The case revolves around an incident on March 13, 2023, when Evans visited The Shoppes at Village Pointe in Boca Raton. According to the complaint, Boca SVP owned the plaza while Janoura Realty managed it and Oilmatic Systems handled waste oil removal. Evans claims he was injured due to negligent maintenance of the premises. "Defendant BOCA SVP owed a non-delegable duty to Plaintiff," states the complaint, alleging that Boca SVP failed to maintain safe conditions in its parking lot and waste removal areas. This negligence allegedly led to Evans's fall caused by used cooking oil or another substance flowing into the parking area.

Evans further accuses Janoura Realty of similar negligence. The complaint asserts that Janoura also had a duty to ensure safety at the plaza but failed to inspect and correct hazardous conditions or adequately warn visitors like Evans about potential dangers. The document highlights how these oversights resulted in significant injuries for Evans.

Oilmatic Systems is similarly accused of negligence regarding their handling of used cooking oil storage containers. The complaint alleges that Oilmatic's failure to properly manage these containers allowed dangerous substances to spill into public areas, directly leading to Evans's accident.

Evans is seeking compensatory damages exceeding $50,000 from each defendant for his injuries and suffering. He cites bodily harm resulting in pain and suffering, mental anguish, medical expenses, loss of earnings capacity, and other related damages as grounds for compensation. Each count within the lawsuit concludes with a demand for judgment against the respective defendant along with interest and costs associated with the legal proceedings.
