A delivery service turned into a nightmare when a man was attacked by a dog, leading to a legal battle over negligence and responsibility. Alain Oriol filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on February 7, 2025, against Gordon E. McGeorge and Pamela P. McGeorge. The lawsuit seeks damages exceeding $50,000 for injuries sustained during the incident.

The case centers around an event that occurred on December 6, 2022, when Oriol was performing a delivery at the residence of Gordon and Pamela McGeorge in St. Petersburg, Florida. According to the complaint, upon opening the door to receive the delivery, two dogs—one being a Terrier Pit Bull mix—exited the house and one of them bit Oriol on his right wrist without any provocation or warning. This attack resulted in serious and permanent physical injuries to Oriol.

Oriol's attorney, Jonathan Rotstein from Rotstein, Shiffman & Broderick LLP, argues that both defendants were negligent in their duty of care as dog owners under Florida Statute 767.04. This statute holds dog owners liable for damages if their dog bites someone who is lawfully on their property. The plaintiff claims that signs reading "Caution Dogs Will Bite" were visible at the premises but did not prevent the attack or provide adequate warning before his arrival.

The lawsuit further details how an investigator from Pinellas County Animal Services (PCAS) met with Oriol after he reported the incident four days later on December 10, 2022. During this meeting and subsequent investigation at the McGeorges' residence, it was confirmed by James Ellis—their grandson—that the dog belonged to his grandparents and had been placed under home quarantine following PCAS protocols.

Oriol accuses both Gordon and Pamela McGeorge of failing to control their dogs adequately and not providing sufficient warnings about their potential danger despite knowing about their aggressive nature. He alleges they breached their duty by allowing these dogs to roam freely during deliveries without proper restraint or notification to visitors like himself.

As part of his claim for relief against each defendant individually as well as collectively through separate counts within this filing document itself; Alain Oriol seeks compensation beyond just monetary value: covering medical expenses incurred due directly from injuries sustained alongside pain suffered physically/mentally throughout recovery process which continues indefinitely into future according statements made therein too!

The attorneys representing Alain Oriol are Jonathan I. Rotstein along with colleagues from Rotstein Shiffman & Broderick LLP located Daytona Beach FL while case assigned Judge Ken Burke presiding over proceedings docketed under ID number #25-000582-CI.
