Douglas Najar has filed a lawsuit against Lake Delray Apartments LLLP, alleging negligence that resulted in serious injuries. The complaint was submitted to the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on January 24, 2025. Najar claims that the apartment complex failed to maintain its premises safely, specifically pointing to a hazardous sewer cover in a handicapped parking spot.

According to the details outlined in the complaint, Douglas Najar was traversing the parking lot of Lake Delray Apartments on April 11, 2023, when he tripped over a protruding sewer cap located in a handicapped parking space. This incident allegedly caused him severe and permanent bodily injuries. Najar asserts that as an invitee on the property, Lake Delray Apartments owed him a duty of care to ensure that their premises were free from dangerous conditions. He accuses the apartment complex of failing to repair or warn about the hazardous sewer cover despite having actual or constructive knowledge of its existence.

The lawsuit lists multiple breaches by Lake Delray Apartments including failure to implement adequate safety policies and procedures for identifying such hazards and not training staff appropriately. The plaintiff's attorney argues that these oversights created "a foreseeable zone of risk" for residents and guests like Najar. As a result of these alleged failures, Najar suffered significant physical and emotional distress along with financial burdens due to medical expenses.

Najar is seeking damages exceeding $50,000 from Lake Delray Apartments LLLP for his injuries and associated costs. He demands compensation for pain and suffering, disability, mental anguish, loss of enjoyment of life, medical expenses both past and future, among other losses which are described as either permanent or continuing.
