Nicholas Webb has filed a lawsuit against a major supermarket chain, accusing it of negligence after he suffered injuries from a slip and fall incident. The complaint was lodged in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on January 21, 2025, targeting Publix Super Markets Inc.
The lawsuit stems from an incident that occurred on July 3, 2024, at a Publix location on Lake Worth Road in Palm Beach County. According to the complaint, Webb was a business invitee at the store when he slipped and fell due to liquid on the floor. The plaintiff alleges that Publix had a non-delegable duty to maintain safe premises for its customers but failed to do so. Webb's attorney argues that the supermarket neglected its responsibility by not ensuring the floor was free from hazardous conditions like accumulated liquids or other substances.
In detailing the negligence claim, Webb accuses Publix of several specific failures: not maintaining the floor in a reasonably safe condition; failing to warn customers about existing dangers; neglecting to place warning signs or barricades around hazardous areas; and not remedying dangerous conditions promptly. "Defendant’s negligence caused Plaintiff to slip and fall on the Premises and caused Plaintiff injury," states the complaint.
Webb claims that as a result of this alleged negligence, he sustained bodily injuries leading to pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, and loss of earning capacity. These damages are described as either permanent or continuing in nature with potential future implications.
The plaintiff is seeking damages exceeding $50,000 from Publix Super Markets Inc., along with any other relief deemed appropriate by the court. He also demands a jury trial for all issues eligible for such proceedings.
Representing Nicholas Webb is Destiny R. Barbosa from Keller Swan PLLC. The case is filed under Case Number 502025CA000577XXXAMB.
