On November 15, 2024, Bobby Safaie and Kustom Rides LLC filed a complaint in the Circuit Court for Palm Beach County, Florida, against BMW of North America, LLC.
The plaintiffs, Bobby Safaie and Kustom Rides LLC, claim that they purchased a 2023 BMW M8 from an authorized dealership on February 2, 2023. Despite assurances and warranties provided by BMW of North America, the vehicle reportedly suffered from multiple defects that impaired its use and safety. According to the complaint, these issues include a defective engine and transmission system evidenced by coolant leaks and malfunctioning warning lights. The plaintiffs argue that despite numerous repair attempts through BMW's authorized dealership network, the problems persist.
The plaintiffs allege that BMW of North America failed to honor its written warranty obligations under the Magnuson-Moss Warranty Act. This federal law requires manufacturers to comply with their written warranties on consumer products. The complaint details how BMW’s warranty promised four years or fifty thousand miles of coverage for various vehicle components but failed to deliver on these promises. "Manufacturer was unable and/or failed to adequately repair the defects," states the complaint.
The plaintiffs are seeking several forms of relief from the court. They demand compensation for the diminished value of their vehicle and any incurred or necessary repair costs. Additionally, they seek incidental and consequential damages resulting from BMW's alleged failure to uphold its warranty obligations. The plaintiffs also request reasonable attorney fees and court costs associated with pursuing this legal action.
