A woman has taken legal action against a major retail corporation, alleging negligence that led to her injury. Silfira Paul filed a complaint on November 15, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Wal-Mart Stores East, LP.
According to the lawsuit, Silfira Paul was shopping at a Walmart store located at 4375 Belvedere Road in West Palm Beach on March 29, 2024. While navigating through the produce section of the store as an invitee, she unexpectedly tripped and fell due to a loose sign protruding from a display. The complaint claims that Walmart failed in its duty to maintain safe premises for its customers by not securing the sign properly. The plaintiff's attorneys argue that this oversight constitutes negligence on the part of Walmart and its employees. They assert that Walmart had a nondelegable duty to ensure safety by maintaining secure displays and warning customers of potential hazards.
The lawsuit details several alleged failures by Walmart: not securing or repairing loose signs; allowing dangerous conditions like protruding signs; failing to inspect and remedy such hazards; lacking adequate policies for detecting dangers; and not warning customers about these risks. As a result of this incident, Silfira Paul claims she suffered significant injuries leading to pain, suffering, disability, disfigurement, mental anguish, medical expenses including surgery costs, and lost wages.
