Plaintiff tenant sues landlords and condo association over mold exposure

Cindy Rotolo has filed a lawsuit against her landlords and the condominium association, alleging negligence that led to serious health issues. The complaint was filed by Cindy Rotolo in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on November 7, 2024, against Violetta Samsel, Andrzej Samsel, and Windy Creek III Condominium Association, Inc.

According to the complaint, Cindy Rotolo began experiencing symptoms related to mold exposure shortly after renting a property from Violetta and Andrzej Samsel on January 1, 2022. The lawsuit claims that the Samsels failed to maintain the premises at 2400 Winding Creek Blvd., Clearwater, Florida, allowing leaks and water seepage that resulted in hazardous black mold growth. "The defendants breached their duty by allowing their house to be in continuous disrepair," states the complaint. Rotolo alleges that this negligence has caused her permanent bodily injuries leading to pain and suffering, disability, mental anguish, loss of enjoyment of life, and medical expenses.

Rotolo also holds Windy Creek III Condominium Association accountable for its role as the real estate company managing the leased premises. Despite multiple complaints from Rotolo about the condition of her residence, Windy Creek III allegedly failed to ensure necessary maintenance was performed. The complaint accuses them of neglecting their responsibility to provide a safe living environment free from hazards like black mold.

In her lawsuit, Cindy Rotolo seeks monetary damages exceeding $50,000 for both past and future losses resulting from these alleged negligent actions. She demands judgment against all defendants for costs incurred due to her injuries and any other relief deemed appropriate by the court. Additionally, she requests a trial by jury.
