In a dramatic legal showdown, a Palm Beach County resident has taken on one of the largest retail giants in the world, alleging negligence and seeking substantial damages. On March 27, 2025, Karina Montgomery filed a complaint against Wal-Mart Stores East LP in the Circuit Court of the 15th Judicial Circuit in Palm Beach County. The lawsuit stems from an incident that occurred on August 17, 2024, when Montgomery claims she suffered significant injuries due to unsafe conditions at a Walmart store.

The complaint details how Montgomery visited the Walmart located at 9990 Belvedere Rd, West Palm Beach as a business invitee. According to her filing, Walmart owed her a duty of care to ensure the premises were safe for customers. However, Montgomery alleges that Walmart breached this duty by failing to maintain or adequately inspect the flooring near aisle 26 B. This alleged negligence resulted in what she describes as an "unreasonably dangerous condition," which led to her slipping and falling on a transient foreign substance.

Montgomery's lawsuit accuses Walmart of multiple acts of negligence. She claims that Walmart failed to warn her about the hazardous condition and did not have adequate policies or staff in place to address such dangers. The complaint lists numerous failures by Walmart, including not maintaining safe flooring surfaces and neglecting to follow their own safety policies. "Negligently failing to act reasonably under the circumstances" is one of many accusations leveled against the retail giant.

The plaintiff seeks damages exceeding $50,000 for bodily injury resulting in pain and suffering, disability, disfigurement, permanent scarring, mental anguish, loss of enjoyment of life, medical expenses, lost earnings, and more. Montgomery asserts these losses are either permanent or ongoing and will continue into the future.
