Estate Representative Alleges Medical Malpractice Against Cardiologist Following Patient's Death

Susan Silver, representing the estate of her deceased husband Jonathan Silver, has filed a lawsuit alleging medical malpractice against a Florida-based cardiologist and his practice. The complaint was filed on October 31, 2024, in the Circuit Court of Palm Beach County, Florida, naming Dr. David Mishkel and Cardiovascular Medicine Associates, P.A., doing business as My Cardiologist, as defendants.

The case revolves around the alleged negligence in the medical care provided to Jonathan Silver by Dr. Mishkel and his practice. According to the complaint, Jonathan Silver had been under the care of Dr. Mishkel since 2019 due to his significant family history of heart disease and other risk factors such as hyperlipidemia and a sedentary lifestyle. Despite these risks being acknowledged by Dr. Mishkel, Susan Silver claims that her husband did not receive appropriate medical intervention.

In particular, Susan alleges that after an abnormal stress test in October 2021 and subsequent tests indicating significant cardiovascular disease in August 2022, Dr. Mishkel failed to take necessary actions such as ordering a cardiac catheterization or providing aggressive treatment for Mr. Silver's condition. Instead, Mr. Silver was advised to take aspirin daily and return for a follow-up with a physician's assistant six months later. Tragically, Jonathan Silver passed away from a myocardial infarction on January 1, 2024.

The lawsuit accuses Dr. Mishkel of failing to meet the standard of care required for treating patients with cardiac risk factors and claims that this negligence directly led to Mr. Silver's death. Furthermore, it holds Cardiovascular Medicine Associates vicariously liable for the actions of its employee.

Susan Silver is seeking damages exceeding $50,000 for mental pain and suffering due to her husband's death, loss of companionship and protection from Mr. Silver, future loss of support and services he would have provided, as well as medical and funeral expenses incurred by his estate.
