A recent court filing brings to light a serious injury claim against a major retail corporation, alleging negligence and premises liability. Phyllis Scott filed the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on August 27, 2024, naming Walmart Inc. as the defendant.
The lawsuit stems from an incident that occurred on November 17, 2023, at Walmart Supercenter #5218 located at 3501 34th St S, St Petersburg, FL. According to the complaint, Scott was shopping at the store and upon exiting to the parking lot, she slipped on numerous landscaping stones scattered on the pavement. This fall resulted in severe and lasting injuries for Scott. The plaintiff asserts that she was walking at a normal pace and using the parking lot as intended when she encountered this hazardous condition.
Scott's legal team argues that Walmart had a duty to maintain its premises in a reasonably safe condition but failed to do so. "At said time and place, there were no signs present in the area of the incident to alert Plaintiff and others lawfully on the premises of the presence of the landscaping stones scattered on the pavement," states one part of the complaint. The lawsuit further alleges that Walmart knew or should have known about this dangerous condition but did not take appropriate measures to rectify it or warn customers.
The plaintiff is seeking damages exceeding $50,000 for bodily injury, great physical pain and suffering, disability, inconvenience, physical impairment, disfigurement and scarring, mental anguish, loss or diminution of earning capacity, permanent injury within a reasonable degree of medical probability, and medical expenses incurred both past and future. The suit also demands judgment for general damages along with costs and interests.
