Resident Sues Property Management Company Over Negligence Leading to Injury

A resident of a Boynton Beach condominium complex has filed a lawsuit alleging negligence against the property management and homeowners association. Walsin Romero filed the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on July 8, 2024, naming Pine Point Villas Association, Inc., and Sea Breeze Community Management Services, Inc., as defendants.

According to the court documents, Romero was injured on August 19, 2023, while sitting in a common area at Pine Point Villas when a chair leg fell into an uncovered hole meant for an underground sprinkler system. The complaint asserts that both Pine Point Villas Association and Sea Breeze Community Management Services were responsible for maintaining the premises and failed to ensure that it was safe for residents. "The Defendants did negligently and carelessly maintain the subject premises so as to cause the Plaintiff to fall and suffer serious and permanent injuries," states the complaint.

Romero's lawsuit claims that Pine Point Villas Association breached its duty by allowing a defective or damaged paver to remain on the walkway. The suit further alleges that Sea Breeze Community Management Services also failed in its responsibility by not addressing this hazardous condition. Both entities are accused of knowing or should have known about the dangerous condition but did nothing to warn residents or rectify it.

The plaintiff is seeking damages exceeding $50,000 for medical expenses incurred due to his injuries, physical handicap, loss of earnings, and impairment of future earning capacity. The injuries are described as permanent and continuing in nature. Additionally, Romero demands a jury trial to resolve all issues triable by jury.
