Estate Accuses Nursing Home Operators of Negligence Leading to Resident's Death

A tragic case has emerged from Pinellas County, Florida, where the estate of a deceased nursing home resident is suing multiple entities and individuals for alleged negligence and wrongful death. The complaint was filed by Walter J. Huff, personal representative of the Estate of Carole A. Huff, in the Circuit Court of the Sixth Judicial Circuit on July 3, 2024, against Boca Ciega Investors, LLC and other associated defendants.

The lawsuit details that Carole A. Huff was admitted to Springs at Boca Ciega Bay on February 9, 2023, and remained there until her discharge on March 3, 2023. The plaintiff alleges that during her stay at the facility operated by Boca Ciega Investors, LLC, Carole A. Huff suffered severe neglect leading to her untimely death on March 10, 2023. According to the complaint, Summit Care II, LLC; Boca Ciega SNF Operations LLC; Summit Care Management LLC; Joseph D. Mitchell; Alan G. Davis; and Vicki Ackerman were all involved in managing or overseeing the operations at Springs at Boca Ciega Bay and thus share responsibility for the alleged misconduct.

Walter J. Huff claims that these entities and individuals failed to provide adequate care for Carole A. Huff as mandated by Florida Statutes §400.023(5). Specific allegations include insufficient staffing levels, failure to monitor significant changes in health conditions, inadequate response to medical needs, and a general lack of reasonable care which led to both physical and emotional suffering for Carole A. Huff.

The plaintiff seeks damages exceeding $50,000 for non-lethal negligence as well as lethal negligence resulting in wrongful death under Florida Statute §400.022. Additionally, they are pursuing claims for breach of fiduciary duty against Boca Ciega Investors, LLC for allegedly misusing funds intended for Carole A. Huff's care and services.
