Tenant Sues Landlord Over Negligence Leading to Severe Injuries

A Pinellas County resident has filed a lawsuit against her landlord, alleging negligence after suffering significant injuries from a fall caused by a protruding nail. Winifred Green lodged the complaint on June 18, 2024, in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, targeting 680 South LLC.

According to the court documents, Green's incident occurred on June 7, 2023. She was ascending the stairs to her apartment at 680 South’s property located at 680 22nd Avenue S., St. Petersburg, Florida when she tripped over a nail sticking out of the flooring at the top of the staircase. The plaintiff claims that this accident resulted in severe physical and mental injuries. The complaint outlines that Green was lawfully on the premises as a tenant and asserts that 680 South LLC had a duty to ensure her safety.

The lawsuit details several accusations against 680 South LLC. It states that the company negligently failed to use reasonable care in constructing, inspecting, maintaining, and repairing the area where Green fell. Specifically, it accuses them of failing to warn about or rectify the dangerous condition posed by the protruding nail. "As a direct and proximate cause of 680 South’s negligence," Green alleges she suffered "bodily injury including permanent injury to the body as a whole, pain and suffering of both physical and mental nature," among other damages such as disability and loss of capacity for enjoyment of life.

Green is seeking damages exceeding $50,000 for her injuries and associated losses. She demands judgment against 680 South LLC for an amount in excess of fifty thousand dollars ($50,000) and requests a trial by jury for all issues triable by right.

Representing Winifred Green is attorney Blake Fromang from Morgan & Morgan P.A., while Judge Ken Burke will be overseeing this case under Case Number: 24-002711-CI.
