A homeowner in Palm Beach County is taking legal action against a local pool service company after a repair job went disastrously wrong, causing extensive damage to his property. Aviram Amir filed the complaint on April 24, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Atlantic Pool & Spa Services, Inc.
The lawsuit arises from a series of unsuccessful attempts by Atlantic Pool & Spa Services to repair a leaking acrylic window in Amir's pool. According to the complaint, these efforts culminated on August 17, 2024, when the defendant injected foam into the wall cavity between the pool and Amir's home. This action allegedly caused the acrylic window to break, resulting in water flooding into Amir's basement and causing substantial damage to his property located at 2198 Isabel Road Oeste, Boca Raton. "Defendant was unable to repair the leak," states the complaint, which accuses Atlantic Pool & Spa Services of negligence for failing to fix the problem and for exacerbating it through their actions.
Amir claims that he has fulfilled all conditions precedent required before filing this lawsuit or that such conditions have been waived by the defendant. The plaintiff argues that Atlantic Pool & Spa Services owed him a duty of care to perform repairs with reasonable skill and care but breached this duty by damaging his home during their repair attempts. As a result of this alleged negligence, Amir's property suffered damages that were foreseeable by the defendant.
In seeking redress from the court, Amir demands judgment against Atlantic Pool & Spa Services for all damages proven at trial. He is also seeking prejudgment and post-judgment interest at the maximum rate allowed by law, as well as reasonable litigation costs and attorney’s fees where permitted by law. Furthermore, Amir requests any additional relief deemed just and proper by the court based on evidence presented.
