Patron sues Ferg's Sports Bar & Grill over alleged negligence over dangerous rug

Amie Yeargin has filed a premises liability complaint against Ferg’s Sports Bar & Grill, Inc., alleging negligence that led to her sustaining serious injuries. The complaint was filed in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, on May 30, 2024.

According to the court documents, Amie Yeargin, a resident of Orange County, Florida, visited Ferg’s Sports Bar & Grill located at 1320 Central Avenue, St. Petersburg, Florida on April 26, 2023. While on the premises as a patron and business invitee, she tripped over a rug and sustained significant personal injuries. Yeargin claims that she was informed that she was the third person to trip over this particular rug at Ferg’s.

The complaint outlines that Ferg’s Sports Bar & Grill had a non-delegable duty to maintain its premises in a reasonably safe condition for its invitees. The plaintiff asserts that the defendant either had actual knowledge or should have had constructive knowledge of the tripping hazard due to its existence for an extended period or because it occurred with regularity. The complaint states: "Defendant owed Plaintiff duties to maintain the premises in a reasonably safe condition and to warn Plaintiff of dangerous conditions on their premises."

Yeargin's lawsuit alleges multiple breaches of duty by Ferg’s Sports Bar & Grill including failure to maintain or adequately inspect the flooring and rugs for hazards; failure to warn patrons about the danger; failure to correct known dangers; insufficient staffing for inspecting and maintaining safety conditions; inadequate training of employees regarding safety inspections; and failure to follow corporate policies regarding such dangerous conditions.

As a direct result of these alleged breaches, Yeargin claims she suffered bodily injury resulting in pain and suffering, disability, disfigurement, permanent scarring, loss of enjoyment of life, medical expenses, loss of earnings capacity, and aggravation of pre-existing conditions. These losses are described as either permanent or continuing.

The plaintiff is seeking damages exceeding $50,001 plus interest and costs from Ferg’s Sports Bar & Grill. She also demands a trial by jury for all triable issues.
