Supermarket Patron Sues Grocery Chain Over Slip-and-Fall Incident

A slip-and-fall incident at a popular supermarket has led to a lawsuit that could have significant implications for store safety standards. On August 28, 2024, Rosemarie Hinds filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Presidente Supermarket No. 53, LLC.

According to the complaint, Hinds alleges that on June 10, 2023, she was an invitee at Presidente Supermarket located at 4360 Okeechobee Blvd, West Palm Beach, Florida. During her visit to the grocery store and cafeteria operated by Presidente Supermarket No. 53, LLC., she encountered hazardous conditions that led to her falling and sustaining injuries. The plaintiff claims that the defendant failed in its duty to maintain a safe environment for its patrons.

The lawsuit outlines several specific accusations against Presidente Supermarket No. 53, LLC. It states that as the owner and operator of the premises, the supermarket had a non-delegable duty of reasonable care to maintain the property in a safe condition. This includes keeping floors and walkways free from transitory foreign objects or substances that might foreseeably cause injury. The plaintiff asserts that Presidente negligently failed to uphold this duty by allowing unsafe conditions such as transient liquids or substances on the floor.

Hinds' complaint details how Presidente allegedly breached its duty of care through multiple failures: not maintaining or inspecting the premises adequately; not correcting known dangerous conditions; and failing to warn patrons about these hazards. Specifically, it mentions water or other liquid substances on the floor near checkout aisles and walkways as contributing factors to her fall.

"Defendant negligently failed to exercise reasonable care in their management of... inspection of... supervision of (including training and/or supervision of Defendant’s own employees)," reads one part of the complaint. Furthermore, it accuses Presidente of not having sufficient policies or training for employees regarding hazard identification and maintenance.

As a result of these alleged lapses in safety protocols, Hinds suffered bodily injury leading to pain and suffering, disability, physical impairment, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings capacity among other damages. She claims these injuries are either permanent or continuing and will affect her future quality of life.

Hinds is seeking compensatory damages along with costs and interest from Presidente Supermarket No. 53 LLC., emphasizing that all issues should be tried by jury as is her right.
