In a compelling legal dispute that underscores the importance of transparency in real estate transactions, Jennifer Fetterolf has filed a lawsuit against Premier Brokers International, Inc. and Ivana Hristodorov. The complaint was lodged on March 31, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida. Fetterolf accuses Premier Brokers International and its associate, Hristodorov, of professional negligence and fraud during her property purchase process.
The case revolves around Fetterolf's attempt to purchase a property located at 2400 S. Ocean Drive, Unit 714, Fort Pierce, Florida. In May 2023, while under contract with Premier Brokers International and assisted by Hristodorov as her real estate sales associate, Fetterolf identified this property for purchase. However, she alleges that crucial information regarding dry wood termites found in the kitchen cabinets was not disclosed to her by Hristodorov despite being informed by the seller’s agent during the inspection period—a critical time when she could have canceled the transaction without penalty.
According to Florida Statutes §475.278(2), transaction brokers are required to disclose all known facts that materially affect the value of residential real property which are not readily observable to buyers. Fetterolf claims this statutory duty was breached when both defendants failed to inform her about the termite issue. Furthermore, after notifying PBI and Hristodorov about receiving loan approval within the stipulated Loan Approval Period (which expired on June 7, 2023), they allegedly neglected to provide necessary written notification to sellers as required by their contract. This oversight resulted in her lender revoking loan approval due to undisclosed conditions of the property, forcing her into a cash transaction instead.
Fetterolf is seeking judgment for monetary damages due to these alleged breaches and negligence from PBI and Hristodorov. She asserts that their actions directly led to financial harm as she had no opportunity to invoke financing or inspection contingencies provided in her contract due to their failure in performing professional duties adequately.
