In the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, a lawsuit was filed by Levi A. Bentham against XPO Logistics Freight, Inc., and Jerrin Handy on March 18, 2024 (Case Number: 24-001240-CI). The complaint seeks damages in excess of $50,000 following a single-vehicle collision that occurred on February 24, 2023.

The plaintiff's lawyer from Wasson & Associates alleges that the accident resulted from gross negligence on part of defendant Handy who was operating a medium-duty Freightliner delivery truck. As per the claim, Handy lost consciousness or became disoriented while driving and failed to control the vehicle which eventually crashed into a guardrail, chain link fence, and a tree before coming to rest in a ditch. The plaintiff was ejected from the truck during this incident resulting in bodily injury and other damages.

Bentham is seeking compensation for his injuries including pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, expense of hospitalization, medical and nursing care treatment costs, loss of earnings as well as future losses.
