The case revolves around an incident that occurred on April 18, 2023, at The Boca Raton Hotel in Florida. Charan-Thomas was attending a convention hosted by Boca Owner where Brian Biro Enterprises conducted a seminar featuring a "Break Through Event." This motivational exercise involved participants breaking wooden boards and assisting others to do the same. According to the complaint, Charan-Thomas was assured by Brian Biro of the event's safety but ended up sustaining serious injuries while holding a board for another participant. The injury included a tear of the left ulnar collateral ligament in her hand necessitating surgical repair.
Charan-Thomas accuses both defendants of negligence. She claims that Brian Biro Enterprises failed to provide a safe environment and neglected proper training and warnings about the risks involved in breaking wooden boards. The complaint states that "Defendant BIRO ENTERPRISES owed a duty to not subject participants to unreasonably unsafe activities," highlighting failures such as inadequate training and inspection of materials used during the event. Similarly, Boca Owner is accused of failing to ensure their premises were safe for business invitees and not investigating previous incidents associated with such events.
The plaintiff seeks judgment for damages exceeding $50,000 from both defendants. She demands compensation for bodily injury, pain and suffering, disability, loss of enjoyment of life, medical expenses, and future losses stemming from her injuries.
