Magen and Diego Aldana sue Learning Adventures Preschool for negligence leading to significant harm to their minor child

In the Circuit Court of the Sixth Judicial Circuit, Pinellas County, Florida, Magen Aldana and Diego Aldana have filed a lawsuit against Learning Adventures Preschool, LLC. The case (24-001260-CI), filed on March 19, 2024, alleges negligence leading to significant harm to their minor child.

The Aldanas claim that while in the care of Learning Adventures Preschool on February 6, 2024, their two-year-old child suffered displaced fractures of the right radius and ulna distal diaphysis. The incident was reported to Diego Aldana via a phone call around 4:30 pm that day. The teacher responsible for their child reportedly refused to provide an explanation or write a report about the incident and was subsequently fired.

The plaintiffs are seeking compensatory and punitive damages exceeding $50,000 for health care expenses, physical pain and suffering, mental anguish, disfigurement, and physical impairment. They argue that the preschool failed to identify hazardous conditions, warn them about these conditions or correct them. Additionally, they accuse the defendant of failing to exercise due diligence in ensuring their child's safety and adequately training its employees.
