In the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, plaintiff Ryan Smithson has filed a lawsuit against Apyx Medical Corporation, previously known as Bovie Medical Corporation. The case (Case Number: 24-001081-Cl) was filed on March 6, 2024.

Smithson, represented by an unnamed counsel, alleges that he suffered personal injuries due to a defective medical product named Renuvion. This product was provided to him during an elective cosmetic surgery on two occasions: March 1, 2021 and December 20, 2021. The defendant is accused of manufacturing, marketing and selling Renuvion for off-label use despite being aware that such usage violated federal regulations and could cause personal injuries and bodily harm. Smithson's injuries include burning, scarring and disfigurement.

The plaintiff is seeking damages in excess of $50,000 exclusive of attorneys’ fees, interest and costs. The court's jurisdiction over this matter is confirmed as it involves an action for damages exceeding the minimum limit.
