Lawsuit: Apple Watch burned customer's wrist

TAMPA -- Apple Inc. has been sued for an allegedly defective watch causing burns to a customer's wrists. 

Phillip Falcon filed a lawsuit on Nov. 1 in Hillsborough County Circuit Court against Apple Inc. and Best Buy Co. of Minnesota, Inc. for negligence, breach of implied warranty of merchantability and strict liability.

According to the complaint, on April 29, 2021, Falcom was wearing an Apple Watch when, without warning, the watch suddenly burned the top of his wrist. Falcon alleges that the watch was defective in design, manufacturing and/or warning customers that such an incident was able to happen. 

Falcon was caused to suffer injury and burns, mental anguish, emotional distress, pain and suffering, the suit says.

Falcon seeks actual damages, consequential damages, economic damages, non-economic damages, cost of suit and interest. Falcon is represented by Branden Weber of Morgan and Morgan, P.A. in Orlando.
