Pinellas County motorist blames another driver for crash

CLEARWATER — A Pinellas County motorist is suing another driver, alleging negligence caused a crash that injured the plaintiff.

Khemala Samlall filed a complaint Feb. 20 in Pinellas Circuit Court against Christian Schwier, alleging the defendant failed to exercise standard care and skill in the operation of a vehicle.

According to the complaint, on Nov. 25, 2015, Samlall was driving east on 22nd Avenue North in Pinellas County. The suit says a car driven by Schwier collided with the bumper on Samlall's car and caused a three-vehicle crash. 

The suit says Samlall sustained permanent bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, medical and nursing care and treatment, loss of ability to earn money and permanent aggravation of a pre-existing condition.  

The plaintiff alleges Schwier failed to adequately maintain and operate a motor vehicle so as not to cause harm, failed to pay attention to traffic and failed keep a proper lookout for other vehicles.

Samlall seeks trial by jury, compensatory damages in excess of $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorneys O. Mark Zamora and Charles Scott of Scott & Fenderson in St. Petersburg.
