Employee accuses health care group of violating FMLA, FLSA

CLEARWATER — A Pinellas County woman is suing health care groups, alleging unpaid wages, retaliation and wrongful termination.

Julia Hernandez filed a complaint Nov. 16 in Pinellas County Circuit Court against Baycare Health Systems Inc. and Baycare Medical Group, Inc., alleging violation of the Family Medical Leave Act and Fair Labor Standard Act.

According to the complaint, on Oct. 8, 2016, Hernandez suffered damages when she was illegally terminated from employment for no reason other than being hospitalized with a serious condition and for not receiving overtime compensation for all worked performed in excess of 40 hours per week. 

The plaintiff alleges the defendants illegally terminated Hernandez from her employment in violation of the FMLA and failed to pay her the required the overtime pay.

Hernandez seeks trial by jury, unpaid overtime, liquidated damages, pre-judgment interest, reasonable attorney fees, court costs and all other relief the court deems just and proper. She is represented by attorneys Wolfgang M. Florin, Robin Orosz and Christopher D. Gray of Florin, Gray, Bouzas, Owens LLC in Lutz.
