JACKSONVILLE — A Duval County woman is suing an insurance company and two individuals, alleging negligence and vicarious liability.
Maria C. Thibault filed a lawsuit Nov. 4 in Duval County Circuit Court against Travis M. Davis, Jay N. Chambers and USAA General Indemnity Company, alleging failure to exercise standard care and failure to cover insurance costs.
According to the complaint, on March 17, 2015, when Thibault was traveling on Beach Road in Jacksonville, a vehicle owned by Chambers and driven by Davis collided with the plaintiff's vehicle. The collision caused Thibault bodily injuries, disabilities, disfigurement, mental anguish, loss of capacity for the enjoyment of life, medical expenses and aggravation of a pre-existing condition.
The plaintiff alleges USAA General Indemnity Company is obligated to fully compensate her claim under the uninsured/underinsured motorist insurance policy in full effect. The suit also says Davis failed to adequately maintain and operate a motor vehicle so as not to cause harm and failed to be on proper lookout for other vehicles.
Thibault seeks trial by jury, damages, costs of suit and all further relief the court deems just. She is represented by attorney Julie M. Harrell of Harrell & Harrell PA in Jacksonville.
