Minnesota guest blames hotel property for injuries

JACKSONVILLE — A Minnesota woman is suing a Duval County hotel property, alleging negligence in failing to present a sexual assault.

Sally Doe filed a lawsuit Nov. 1 in Duval County Circuit Court against Ashford TRS Pool A LLC, One Ocean Resort Hotel & Spa and Ashford Atlantic Beach LP, alleging failure to to exercise standard and reasonable care.

According to the complaint, on Aug. 14, 2014, Doe was at the defendants' property as a hotel guest. The suit says while using the hotel gym, she was attacked, kidnapped and sexually battered by Joshua Gloston,

The suit says the attack caused her to sustain multiple trauma and injuries, including bodily injury, pain and suffering, inconvenience, impairment, mental anguish, and medical and psychological expenses. 

The plaintiff alleges the defendants created a dangerous atmosphere for guests from a lack of deterrence to prevent a criminal attack, failed to warn guests of the existence of dangerous conditions and failed to implement adequate security policies, measures and procedures.

Doe seeks trial by jury, damages of more than $15,000, interest and costs. She is represented by attorneys Edward McCarthy III of Rogers Towers PA in Jacksonville, and by Joshua A. Woolsey of Woolsey Law PLLC in Jacksonville.
