Mechanic sues former employer over alleged violation of FLSA

Salary02

ORLANDO — A mechanic is suing Hosey's Auto Parts & Service Inc. and Randy S. Sessler, former employer, citing alleged violation of the Fair Labor Standards Act (FLSA).

Lester Lee Sessler filed a complaint on Oct. 17, in the U.S. District Court for the Middle District of Florida against the defendants alleging that they failed to pay employees for all hours worked at a correct rate.

According to the complaint, the plaintiff alleges that, from 1980 through December 2015, he was employed by the defendant as a mechanic and regularly worked approximately 55 to 60 hours per week, but was not properly compensated for overtime hours rendered or paid minimum wage as a non-exempt employee, as required by the law, which caused the plaintiff to suffer injury.

The plaintiff holds Hosey's Auto Parts & Service Inc. and Randy S. Sessler responsible because the defendants allegedly failed to maintain all records of hours worked by its employees, and failed to compensate employees with the proper minimum wage and overtime premiums.

The plaintiff requests a trial by jury and seeks judgment against the defendant, unpaid wages, interest, attorney's fees, costs of action and other relief the court deems just. He is represented by N. James Turner of N. James Turner Attorney At Law in Orlando.
